Licensing & Social Responsibility
All staff working in licensed premises are required to understand licensing law and responsible serving practices, therefore it is essential to ensure that all employees undergo comprehensive licensing training to ensure they are fully aware of their responsibilities in serving alcohol.
Licensing & Social Responsibility (Scotland)
The Licensing (Scotland) Act 2005 states that all staff who wish to sell or serve alcohol in licensed premises must have received at least 2 hours of training, prior to starting work, to ensure that they fully understand licensing law and responsible serving practices.
The Licensing & Social Responsibility training module has been developed to meet the training specification set by the Scottish Government, and fulfills the 2 hours training required for all staff in licensed premises as of 1st September 2009.
The Flow staff licensing training module also includes the changes to the Scottish Licensing Act coming into force on the 1st October 2011, known as the Alcohol Act (Scotland) 2010. These changes in summary are:
i. Age Verification Policy – Challenge 25. Every licensed premises in Scotland will require to operate an age verification policy. This policy should state that any customer who looks under 25 will require to prove that they are 18 or over before they can purchase alcohol. Failure to implement the policy will be a breach of your premises licence conditions and could potentially negate a due diligence defence in relation to age related offences.
ii. Weights and Measures (Specified Quantities) (Unwrapped Bread and Intoxicating Liquor) Order 2011. The current legislation for serving beer is in quantities of 1/3, ½ and a pint and multiples of ½ pints. As of October 1st the 2/3 pint can be made available to customers. This is not becoming mandatory however as it will be up to operators to decide whether or not to stock the new glassware and offer it to customers.
iii. Wine - wine is currently sold as 125ml or 175ml or multiples of both.Specified quantities will no longer apply to servings of wine below 75ml. This will allow for the sale of small glasses of wine as samples or as part of a wine flight. There is no requirement to sell by quantity below 75ml, but, if the operator chooses to do so appropriate measures should be used
iv. Fortified wines - these wines must be sold as 50ml or 70ml or multiples of both
Licensing & Social Responsibility (England & Wales)
This module guides you through all the essential information required to work with alcohol in licensed premises in England and Wales. The module explores the Licensing Act (2003), the effects of alcohol, social responsibility and offers guidance on dealing with drugs and conflict on licensed premises.
Although it is not currently a legal requirement to provide your staff with licensing training in England & Wales, it is currently under review and likely to come into effect in the near future.
As of 1st October 2010, it became a legal requirement for all premises licensed to sell alcohol to have an ‘age verification’ policy and that pubs, restaurants and other retailers must offer customers drinks in smaller sizes.
Training in all aspects of licensing and social responsibility is however carried out by the majority of responsible operators in England and Wales, and is recommended as best practice by both the Licensing Standards Authorities and the Police.
